РЕГЛАМЕНТ (ЕС) № 395/2010 НА КОМИСИЯТА
от 7 май 2010 година
за изменение на Регламент (ЕО) № 1010/2009 по отношение на административните споразумения относно сертификатите за улов
ЕВРОПЕЙСКАТА КОМИСИЯ,
като взе предвид Договора за функционирането на Европейския съюз,
като взе предвид Регламент (ЕО) № 1005/2008 на Съвета ( 1 ) от 29 септември 2008 г. за създаване на система на Общността за предотвратяване, възпиране и премахване на незаконния, недеклариран и нерегулиран риболов, и по-специално член 12, параграф 4, член 14, параграф 3, член 20, параграф 4 и член 52 от него,
като има предвид, че:

Административните споразумения, съгласно които сертификатите за улов са изготвени, заверени или изпратени по електронен път или са заменени с електронни системи за проследяване, осигуряващи същата степен на контрол от страна на органите, се изброяват в приложение IX към Регламент (ЕО) № 1010/2009 на Комисията от 22 октомври 2009 г. за определяне на подробни правила за прилагането на Регламент (ЕО) № 1005/2008 ( 2 ) . Понеже бяха одобрени нови административни споразумения относно сертификатите за улов, това приложение следва да бъде актуализирано.

Регламент (ЕО) № 1010/2009 следва да бъде съответно изменен.

Административните споразумения относно сертификатите за улов, установени в приложението, се базират на електронни системи за проследяване, които са съществували преди влизането в сила на Регламент (ЕО) № 1005/2008, следователно настоящият регламент следва да се прилага от 1 януари 2010 г.

Мерките, предвидени в настоящия регламент, са в съответствие със становището на Управителния комитет по рибарство и аквакултури,
ПРИЕ НАСТОЯЩИЯ РЕГЛАМЕНТ:
Член 1
Приложение IX към Регламент (ЕО) № 1010/2009 се изменя, както е определено в приложението към настоящия регламент.
Член 2
Влизане в сила
Настоящият регламент влиза в сила на седмия ден след публикуването му в Официален вестник на Европейския съюз .
Той се прилага от 1 януари 2010 г.
Настоящият регламент е задължителен в своята цялост и се прилага пряко във всички държави-членки.

ПРИЛОЖЕНИЕ
В приложение IX към Регламент (ЕО) № 1010/2009 се добавят следните раздели 4, 5 и 6:
„Раздел 4
ИСЛАНДИЯ
СХЕМА ЗА СЕРТИФИЦИРАНЕ НА УЛОВА
В съответствие с член 12, параграф 4 от Регламент (ЕО) № 1005/2008 сертификатът за улов, предвиден в член 12 и приложение II към горепосочения регламент, от 1 януари 2010 г. се заменя — за продукти от риболов, получени от улов, извършен от риболовни съдове, плаващи под флага на Исландия — с исландски сертификат за улов, основан на исландската система за претегляне и записване на улова, която представлява електронна система за проследяване под контрола на исландските органи и гарантира същото ниво на контрол от органите, което се изисква съгласно схемата на ЕС за сертифициране на улова.
Образецът на исландския сертификат за улов е даден в допълнението.
Документите, посочени в член 14, параграфи 1 и 2 от Регламент (ЕО) № 1005/2008, могат да бъдат изпращани по електронен път.
Исландия изисква сертификат за улов за разтоварвания на сушата и внос в Исландия на улов, извършен от риболовни съдове, плаващи под флага на държава-членка на Европейския съюз.
ВЗАИМОПОМОЩ
Взаимопомощта, предвидена в член 51 от Регламент (ЕО) № 1005/2008, се развива с цел да се улесни обменът на информация и помощта между съответните органи на Исландия и на държавите-членки на Европейския съюз, въз основа на подробните правила за взаимопомощ, определени в настоящия регламент.

КАНАДА
СХЕМА ЗА СЕРТИФИЦИРАНЕ НА УЛОВА
В съответствие с член 12, параграф 4 от Регламент (ЕО) № 1005/2008 сертификатът за улов, предвиден в член 12 и приложение II към горепосочения регламент, се заменя — за продукти от риболов, получени от улов, извършен от риболовни съдове, плаващи под флага на Канада — с канадски сертификати за улов, основани на канадската система за сертифициране на улова (FCS) (описана в допълнение 3), която представлява електронна система за проследяване под контрола на канадските органи и гарантира същото ниво на контрол от органите, което се изисква съгласно схемата на ЕС за сертифициране на улова.
Образци на канадските сертификати за улов, които заменят сертификата за улов на Европейската общност и сертификата за реекспорт от 1 януари 2010 г., са дадени в допълнения 1 и 2.
Уловът с помощта на местни риболовни техники или от риболовни съдове, определени в член 6 от настоящия регламент, се придружава от опростен канадски сертификат за улов, даден в допълнение 2.
Документите, посочени в член 14, параграфи 1 и 2 от Регламент (ЕО) № 1005/2008, могат да бъдат изпращани по електронен път.
ВЗАИМОПОМОЩ
Взаимопомощта, предвидена в член 51 от Регламент (ЕО) № 1005/2008, се развива с цел да се улесни обменът на информация и административното сътрудничество между съответните компетентни органи на Канада и държавите-членки на Европейския съюз, въз основа на подробните правила за взаимопомощ, определени в настоящия регламент.

Допълнение 3
Канадската система за сертифициране на улова (FCS) предвижда издаването на стандартни и опростени сертификати за улов.
FCS ще бъде използвана, за да се издава и заверява сертификат за улов за партиди за износ от Канада за Европейския съюз на конвенционални продукти от риболов, като жива, прясна, замразена, осолена, консервирана и/или пушена и сушена риба, за които се използва суровина от риболов без участието на риболовен съд, от риболов с местни техники или от малки и големи риболовни съдове и/или чието производство се извършва на няколко етапа на производствения процес.
Канада ще групира някои съдове на опростените сертификати, за да увеличи максимално ефикасността. FCS обаче ще поддържа пълен указател към групираните съдове и те ще са свързани със своя лиценз или регистрационна информация и с декларирания улов на сертификата.
Това групиране ще бъде използвано за някои видове продукти, и по-специално за продукти от риболов, при който се използват събирателни съдове, които купуват от няколко риболовни съда и издават бележки за продажба в морето, от риболов без участието на риболовни съдове като брегова мрежа, събиране на морски организми по плажа, риболов върху лед, от някои видове риболов около брега и от риболов с местни техники, които могат да се извършват на равнището на една общност. Групиранията ще бъдат специфични за всяко износно дружество и ще се променят за всяка доставка според нуждите.
Това групиране ще позволи на Канада да представи един сертификат за всяка доставка, като в същото време запази в базата данни цялата информация, свързана със сертификата (лиценз/регистрация на съда).
Тази информация ще бъде достъпна за органите на държавите-членки на ЕС в държавите-вносителки чрез нашия уебсайт или по пряка телефонна линия до нашето сертифициращо бюро.
Трети държави също могат да се свързват със сертифициращото бюро за информация относно непряк внос.

ФАРЬОРСКИ ОСТРОВИ
СХЕМА ЗА СЕРТИФИЦИРАНЕ НА УЛОВА
В съответствие с член 12, параграф 4 от Регламент (ЕО) № 1005/2008 сертификатът за улов, предвиден в член 12 и приложение II към горепосочения регламент, се заменя — за продукти от риболов, получени от улов, извършен от риболовни съдове, плаващи под флага на Фарьорските острови — със сертификат за улов на Фарьорските острови, основан на системата на Фарьорските острови за документи за продажба и дневници, която представлява електронна система за проследяване под контрола на органите на Фарьорските острови и гарантира същото ниво на контрол от органите, което се изисква съгласно схемата на ЕС за сертифициране на улова.
Образец на сертификата за улов на Фарьорските острови, който заменя сертификата за улов на Европейската общност и сертификата за реекспорт от 1 януари 2010 г., е даден в допълнението.
Документите, посочени в член 14, параграфи 1 и 2 от Регламент (ЕО) № 1005/2008, могат да бъдат изпращани по електронен път.
ВЗАИМОПОМОЩ
Взаимопомощта, предвидена в член 51 от Регламент (ЕО) № 1005/2008, се развива с цел да се улесни обменът на информация и административното сътрудничество между съответните компетентни органи на Фарьорските острови и държавите-членки на Европейския съюз, въз основа на подробните правила за взаимопомощ, определени в настоящия регламент.
